The Supreme Court firmly rejected a petition on Monday seeking to grant a bachelor's degree in law within three years after the 12th grade but also acknowledged the concerns of the petitioner, Ashwini Upadhyay. Chief Justice D.Y. Chandrachud, in his remarks, recognized the petitioner's contention that the current five-year duration for the BA-LLB course might be inadequate but also emphasized that even five years seem insufficient due to the comprehensive nature of legal education.
This petition, filed under public interest in the Supreme Court, not only sought directions to offer a three-year bachelor's course in law after the 12th grade but also raised a compelling argument. The petitioner, Ashwini Upadhyay, vehemently contended that the five-year duration for a law bachelor's degree is not only inappropriate but also illogical, sparking a crucial question about the current system.
The petitioner, Ashwini Upadhyay, proposed forming a special committee of experts with a deep understanding of legal education. This committee would assess the feasibility of introducing a three-year course in law. Several degree programs, such as the Bachelor of Science, Bachelor of Commerce, and Bachelor of Arts, are comparable.
Ashwini Upadhyay stated in the petition that students can efficiently study 15-20 subjects across six semesters in three years. Hence, the five-year duration is deemed unnecessary for students. Additionally, the petition argued that there is no need for such a lengthy duration to obtain a bachelor's degree, especially when other Bachelor's degree programs typically take three years to complete. Examples include the Bachelor of Science, Bachelor of Commerce, and Bachelor of Arts.
